1. Definitions

In these Terms and Conditions, the following terms apply:

• "ssundas", "we", "us", "our" — ssundas, a yacht tour operator registered and based in Langkawi, Kedah, Malaysia.
• "Guest", "you" — any person who books or participates in a ssundas tour.
• "Tour" — any of ssundas's organised yacht excursions, including the Geopark Coastal Cruise, Four Islands Langkawi Day, and Langkawi to Tarutao Overnight.
• "Booking" — a confirmed reservation for a Tour made by a Guest.
• "Agreement" — these Terms and Conditions as accepted by the Guest.

2. Acceptance of Terms

By making a Booking with ssundas, you confirm that you have read, understood, and agreed to these Terms and Conditions. You must be at least 18 years of age to make a Booking. Guests under 18 may participate with the consent of and in the company of a parent or legal guardian who accepts these Terms on their behalf.

3. Booking and Confirmation

A Booking is considered confirmed when ssundas provides written confirmation by email or message. ssundas reserves the right to decline any Booking at its discretion. All bookings are subject to availability.

For the Langkawi to Tarutao Overnight tour, we recommend making a Booking at least four weeks in advance to allow sufficient time for permit preparation and crew scheduling.

4. Payment

Prices are quoted in Malaysian Ringgit (MYR) and are per person unless stated otherwise. Payment terms and accepted methods will be confirmed at the time of Booking. All prices are inclusive of the services described in each tour's specification.

Prices do not include personal travel insurance, gratuities, or any costs arising from delays or extensions beyond the guest's control.

5. Cancellation by Guest

• Cancellations received more than seven (7) days before the departure date: full refund.
• Cancellations received within seven (7) days of the departure date: no refund, however we will make reasonable efforts to reschedule the Booking to a mutually convenient date.
• Failure to appear on departure without prior notice: no refund.

6. Cancellation by ssundas

ssundas reserves the right to cancel any Tour if sea or weather conditions do not meet our safety standards. In such cases, Guests will be offered a reschedule to the next available date at no additional cost, or a full refund. ssundas will notify Guests of any cancellation as early as possible, and in most cases at least 24 hours before the scheduled departure.

ssundas is not liable for any travel, accommodation, or related costs incurred by Guests as a result of a Tour cancellation due to weather or conditions.

7. Health and Safety

Guests must disclose any relevant health conditions, mobility limitations, or concerns about seasickness at the time of Booking. This information enables our crew to plan appropriately and advise whether a particular Tour is suitable.

The Captain retains final authority over all safety decisions on board. Guests must follow all safety instructions from crew members. ssundas may refuse participation to any Guest who, in the crew's judgement, poses a risk to themselves or others.

Guests are strongly encouraged to take out appropriate personal travel and activity insurance prior to participation.

8. Conduct on Board

Guests are expected to treat crew members and fellow guests with courtesy and respect. ssundas reserves the right to refuse service or request disembarkation, without refund, for any Guest whose conduct is disruptive, unsafe, or in violation of these Terms.

The following are not permitted on board: possession or use of illegal substances, aggressive or threatening behaviour, tampering with safety equipment, or any activities that endanger the vessel, crew, or fellow guests.

9. Cross-Border Voyages

For the Langkawi to Tarutao Overnight tour, Guests are required to hold a valid passport with sufficient validity for Thai entry requirements. Guests are responsible for ensuring they meet Thai and Malaysian immigration requirements. ssundas manages the permit application process and coordinates with relevant authorities, but cannot be held responsible if a Guest is denied entry by immigration officials for reasons related to the Guest's own documentation or status.

10. Intellectual Property

All content on ssundas's website, including text, photography, and design, is the property of ssundas and may not be reproduced without written permission. Guests may photograph and film for personal use during Tours. Commercial use of images taken during Tours requires ssundas's written consent.

11. Liability and Disclaimers

ssundas operates with due care and in accordance with Malaysian maritime regulations. However, participation in water-based activities involves inherent risk. To the extent permitted by Malaysian law, ssundas's liability for any claim arising from a Tour is limited to the price paid for that Tour.

ssundas is not liable for injury, loss, or damage resulting from: weather events beyond our control, Guest failure to follow safety instructions, pre-existing medical conditions not disclosed at Booking, or activities Guests undertake independently while ashore.

12. Personal Data

ssundas collects and processes personal data in accordance with our Privacy Policy and the Personal Data Protection Act 2010 (Malaysia).

13. Governing Law

These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from or related to these Terms shall be subject to the non-exclusive jurisdiction of the Malaysian courts. ssundas will attempt to resolve disputes informally in the first instance. 14. Changes to Terms

ssundas may update these Terms and Conditions from time to time. The current version will always be available on our website. Bookings made before any changes will be governed by the Terms in effect at the time of Booking, unless the Guest agrees otherwise.
